Is Mediation Mandatory Before Filing Suit Against a Condo Association?

Yes. Under § 718.1255 of the Florida Statutes, condominium association disputes must be addressed through alternative dispute resolution like mediation before a lawsuit can be filed. Florida law even requires residential condominiums to include terms in their bylaws that require non-binding arbitration.
